State and Territory Licensing Departments

Each state and territory Government is responsible for legislation under which child care services are licensed. This is administered by the relevant licensing department in each state and territory.

Licensing provides a legal 'floor' below which no service is permitted to operate. Licensing includes factors which are most readily measured, such as space, range of equipment, number and ages of children, number of staff and the length of their training.

Services:

Children's Policy and Regulation Unit administers ACT Government legislation in relation to the licensing and monitoring of children's services in the ACT. Licensed children's services include:

  • centre-based children's services
  • school age care
  • family day care
  • independent preschools and playschools.

Licensing ensures that children's services in the ACT meet the requirements of the Children and Young People Act 1999, and related Conditions for Approvals in Principle and Licences.

Children's Policy and Regulation Unit provides:

  • professional advice about the planning, design and establishment of new services and enhancements to existing services
  • an advisory service for families, children's services and the community regarding child care and other services available for children within the ACT.

The Department of Education and Training's Early Childhood Services unit is responsible for:

  • integrated early childhood services
  • child care licensing
  • new children's services regulations
  • community engagement about early childhood and parenting
  • preschools, mobile preschools, play groups and the early years of school.

The unit assists child care services to meet their legislative obligations and to strive for a quality of care beyond the minimum requirements.

Services:

The Department for Communities administers the Child Care Services Act 2007 and related regulations through the Child Care Licensing Standards Unit. The Child Care Licensing Standards Unit:

  • assesses and processes licence applications
  • provides information to help service providers understand and comply with the regulations
  • monitors child care services to ensure compliance with the regulations
  • responds to concerns and complaints of non-compliance with the regulations.
